1. Acceptance of Terms

By accessing bondofcolours.com or placing an order with Bond of Colours (“Seller”), you (“Buyer”) agree to be bound by these Terms and Conditions. These terms apply to all sales, including online orders, phone orders, and custom quotes.

2. Commercial Use Only

Bond of Colours is a B2B (Business-to-Business) distributor. By placing an order, you certify that:

• You are purchasing products for commercial, professional, or industrial use.

• You have the technical knowledge to safely handle, store, and dispose of chemical products.

• Household Use Warning: Our products are high-concentration industrial and food-grade raw materials. They are not intended for direct consumer use or household applications without further processing.

3. Product Usage & Liability

• Buyer’s Responsibility: The Buyer is solely responsible for determining the suitability of any product for their specific application.

• Grade Distinction:

  • FDA Certified Dyes: Suitable for food, drug, and cosmetic use strictly in accordance with FDA 21 CFR limitations.

  • Industrial Dyes: Strictly prohibited for use in food, drugs, or cosmetics applied to mucous membranes.

• Indemnification: The Buyer agrees to indemnify and hold harmless Bond of Colours from any claims, damages, or liabilities arising from the misuse, improper storage, or non-compliant application of our products.

4. Orders, Pricing & Payment

• Pricing: Prices are listed in USD and are subject to change without notice. Mistakes in pricing (e.g., $0.00 listed due to error) will be corrected, and the Seller reserves the right to cancel such orders.

• Taxes:

  • USA: Buyers are responsible for all applicable state and local sales taxes unless a valid Resale Certificate is on file.

  • Canada: Buyers are responsible for GST/HST/PST and import duties upon delivery (DDU).

• Payment Terms: Orders must be paid in full before shipment via Credit Card, PayPal, or Bank Wire. Net-30 terms are available only for approved commercial accounts.

5. Shipping & Risk of Loss

• FOB Origin: All shipments are made FOB (Free on Board) from our facility in Dorchester Center, MA.

• Transfer of Title: Title and risk of loss pass to the Buyer once the carrier (FedEx/UPS/USPS) picks up the package from our warehouse.

• Delays: Bond of Colours is not liable for production delays caused by carrier interruptions, customs holds, or force majeure events.

6. Warranty Disclaimer

• As-Is: Products are sold “as is” and “with all faults,” except as explicitly stated in the Certificate of Analysis (COA).

• Limited Warranty: Seller warrants that the product conforms to the specifications provided in the COA at the time of shipment.

• No Other Warranties: SELLER MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

7. Limitation of Liability

IN NO EVENT SHALL BOND OF COLOURS BE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR DOWNTIME). OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE PURCHASE PRICE OF THE SPECIFIC PRODUCT THAT CAUSED THE CLAIM.

8. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Illinois, without regard to its conflict of law principles. Any legal action must be brought in the state or federal courts located in Illinois, USA.
